1. Acceptance of Terms

By accessing or using AIPromptKit ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use the Service.

2. Description of Service

AIPromptKit is an AI-powered prompt building tool that helps users create optimized prompts for various AI image, video, text, and music generation platforms. The Service uses third-party AI providers including Anthropic (Claude), OpenAI, and Google (Gemini) to power features such as prompt optimization and image analysis.

3. Third-Party AI Services

The Service integrates with third-party AI providers. By using AI-powered features, you also agree to the terms of these providers:

• Anthropic (Claude) — Your prompts and images sent for analysis are processed by Anthropic's API. Anthropic's usage policy (https://www.anthropic.com/policies) applies to all content processed through their services. Anthropic may use data as described in their privacy policy.
• OpenAI — Content processed via OpenAI's API is subject to OpenAI's terms of use (https://openai.com/policies). OpenAI may retain data as described in their data usage policy.
• Google (Gemini) — Content processed through Google's Gemini API is subject to Google's terms of service (https://ai.google.dev/terms). Google may process data according to their privacy policy.

4. Subscription & Billing

Certain features, including AI prompt optimization and AI image analysis, require an active Pro subscription. Billing is usage-based and managed through Polar.sh. By subscribing, you agree to Polar's terms of service. You may cancel your subscription at any time through the customer portal.

5. User Responsibilities

You agree not to:

• Use the Service to generate content that is illegal, harmful, or violates the rights of others.
• Attempt to reverse-engineer, disassemble, or circumvent any security measures of the Service.
• Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users.

6. Intellectual Property

Prompts you create using the Service belong to you. However, AIPromptKit and its branding, code, and design are the intellectual property of the Service owner. The AI-generated outputs are subject to the respective AI provider's output ownership policies.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use of the Service, including but not limited to the quality of AI-generated content, service interruptions, or data loss. AI outputs may be inaccurate or unexpected — always review generated content before use.

8. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.
